The 10th U.S. Circuit Court of Appeals ruled that Krystal Etsitty had no legal recourse in fighting her firing by the Utah Transit Authority in 2005.
The court, which sits in Denver, found that the trial judge was correct in finding that the transit authority feared it could be sued by people born biologically female if it were discovered Etsitty still had male genitals.
At the time of her firing Etsitty was transitioning from male to female.
She was undergoing hormone therapy, wearing women’s clothing and presenting herself as female. ”

I don’t think I would phrase it in those terms. They only have the same civil rights as everyone else does. The statement is false and borders on propaganda.
They are an extreme minority. And it is a choice life. It is an excellent decision then. Gays are not a choice. But, most trangendered people have the choice to be that way.
They shouldn’t be covered. They should have the right to get psychological help for their mental illness and nothing more.
They called her change “too drastic to protect”… which I find silly.
If someone was born with both sexes genitalia, they would have the exact same surgeries AND be protected under the Americans With Disablities Act.
I don’t have any opinions on whether Transexuals are right, wrong, confused or whatever… I think it varies.
But the law should obviously protect EVERYONE and as long as this person is performing the duties of her job, I see no reason that they should fire her for what’s going on in her sex life…
Kirk Neal - What are you saying? If a person is “confused” then they don’t deserve protection under the law at least as humans???
They have the same rights as the rest of us. Personally, I think restrooms/locker rooms should come in threes: male only, female only, coed/other. That would help a lot of situations.
That is very sad. Unfortunately there is still a lot of fear and/or ignorance around on the topic of transsexualism. Because it’s something many people aren’t used to seeing.
I can kind of understand if she was working - for instance - in a women’s clothing store. Some female customers might become rather unsettled at the thought of somebody who used to be a man measuring their bra size. But I honestly can’t think of too many other jobs that it would apply to, if any.
I guess some people just have way too much spare time on their hands. Hopefully it won’t always be like this.
Not any more rights than other citizens.
